These Terms & Conditions govern the usage of our software products, ERP/CRM systems, and any related services provided by CloudsBySunil.

1. Definitions

  • Client: The individual or business engaging with CloudsBySunil.

  • Product: Any software or digital service developed by the Company.

2. Use of Services

  • All products are licensed, not sold.

  • You may not copy, distribute, or modify any proprietary software unless stated.

  • You agree to not use the service for illegal activities or violate any laws, including the Information Technology Act, 2000.

3. Intellectual Property

  • All source code, designs, algorithms, and documentation are the intellectual property of CloudsBySunil unless otherwise agreed in writing.

  • Transfer of IP, if applicable, is subject to full payment.

4. Client Obligations

  • Cooperate and provide accurate inputs for software delivery.

  • Ensure secure login usage; you are responsible for account misuse.

5. Payment Terms

  • All payments must be made as per invoice terms (usually 50% upfront).

  • Late fees may be charged after 7 days of delay.

6. Software Support

  • Support terms vary per project, and AMC (Annual Maintenance Contracts) are available upon agreement.

7. Limitation of Liability

We shall not be liable for:

  • Data loss due to third-party hosting or client-side negligence.

  • Downtime caused by force majeure or third-party failures.

Privacy Policy

CloudsBySunil (“Company”, “we”, “us”, or “our”) is committed to protecting the privacy of our clients and users. This Privacy Policy is designed in accordance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 under the IT Act, 2000.

1. Data We Collect

  • Personal Information: Name, email, phone, address, and company info.

  • Sensitive Data: GST details, PAN (if provided voluntarily).

  • Technical Data: IP address, login details, browser type, usage logs.

  • Transactional Data: Payment info (processed via secure payment gateways).

2. Purpose of Data Collection

  • To deliver software solutions and technical services.

  • For customer communication and technical support.

  • For invoicing, compliance, and KYC.

  • For analytics, marketing (with consent), and service improvement.

3. Consent

By using our website or services, you consent to our collection and use of data as outlined here.

4. Data Sharing

We may share your data with:

  • Government authorities if legally required.

  • Third-party service providers (e.g., hosting, payment gateways).

  • No data is sold or rented.

5. Security Measures

Cancellation & Refund Policy

We value transparency and quality in our software delivery. However, due to the customized nature of our services, our cancellation and refund policies are as follows:

1. Project Cancellation

  • Clients can cancel within 7 days of project kickoff by submitting a written request.

  • If work has begun, the cost of hours worked, tools purchased, and setup fees will be deducted.

2. Refunds

  • No refunds after final delivery or once the software is deployed or credentials are shared.

  • For subscription-based products (if applicable), refund is only available within 7 days of purchase, provided less than 20% of usage is consumed.

3. Non-Refundable Items

  • Domain names, server costs, SSL, third-party licenses, plugin/API integrations, and manpower charges.

  • Custom-designed UI/UX and integration work.

4. How to Request a Refund

Send an email to admin@cloudsbysunil.com with:

  • Subject line: “Refund Request –  Project Name “

  • Details: Invoice ID, Date of Payment, Reason

Refunds (if eligible) will be processed within 7–10 business days via the original payment method.

5. Indian Consumer Protection

In compliance with the Consumer Protection Act, 2019, we maintain fairness and accountability in handling client issues.
